Familiarize with the basic information related to personal data processing at Atrem S.A.

One of the essential aspects of business activity is the necessity of processing personal data. Data allowing for the identification of natural persons is used by us on a daily basis and, for instance it is related to: potential and current employees, clients and counterparties of Atrem S.A. Due to a significant impact of breaching such data on personal property of natural persons, the Atrem company considers it particularly important that the undertaken actions related to personal data processing are compliant with the applicable law and the rules of internal information security policy.

In particular, the rules for processing personal data are governed by the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as the GDPR whose primary objective is to provide the necessary instruments for every person to have more control over their own personal data.

Atrem S.A. has a responsible and diligent approach to personal data protection as well as ensures a high protection level of processing thereof. The primary goal of company’s internal regulations is to maintain personal data processing at Atrem S.A. that ensures their safety, in particular protection against disclosure to unauthorized persons, processing contrary to the provisions of law, modification, loss, damage or destruction.

Basic information related to processing and protection of natural persons’ personal data used by Atrem S.A. for the purposes of conducting business activity have been included below.

Data Controller

Collection of personal data

Atrem S.A. collects natural persons’ data through interactions, in particular through providing services and products as well as on the basis of employment contracts. The vast majority of data is provided to the Company directly by data subjects as well as other entrepreneurs cooperating with the Company, e.g. as contact data of subcontractors’ employees.

The Company processes, inter alia, the data of the following persons:

  • Persons entering the premises of Atrem S.A. company seat (CCTV);
  • Potential employees;
  • Employees or associates of counterparties;
  • Suppliers (natural persons or representatives of legal persons) registered in the procurement portal;
  • Persons submitting enquiries, being natural persons or representatives of legal persons.

We would like to inform that the “Career” tab allows submitting a job application related to a specific recruitment process as well as submitting the so-called “spontaneous” application which is not related to a specific recruitment process. Submitting an application involves personal data processing. You will be redirected to our partner’s website. Personal data processing is conducted by our partner and in accordance with their regulations. Our partner’s “cookie” policy can be found at: https://erecruiter.pl/polityka-cookies/.

In case of submitting an application related to our recruitment processes, the personal data controller shall be Atrem S.A.

Consents and information on the detailed scope of processing of personal data included in the application have been attached under the application form. Please read the entire content.

Due to the use of cookies when visiting the portal, the end device (computer, tablet, smartphone) shall store information that enables the algorithm to associate your activity with the internet browser. This allows us to analyze the use of our website in order to implement improvements. Cookie files (so-called cookies) are small text files sent by the visited website to the user’s device (computer, smartphone, etc.). Cookies do not include any personal data. The following scope shall be recorded by us:
a) date and time of visiting the websites or subsites;
b) time spent on each subsite;
c) fact of clicking on active website elements (buttons, links);
d) relations and time effects between the above-mentioned events;
e) frequency of visiting the websites and subsites.

We would like to emphasize that the collected personal data does not aim at determining your identity, and the received reports do not allow for distinguishing the activity of a single user – the information is only of a statistical nature.

Atrem S.A. collects and processes personal data mainly based on the following:

  • free consent,
  • fact of contract execution,
  • the necessity of performing legal obligations,
  • execution of legally justified interests, e.g. pursuing claims or performance of marketing activities related to own products and services.

Atrem S.A. uses personal data in order to:

  • execute contracts concluded by the Company;
  • ensure protection of persons remaining on the premises of the data controller, including protection of employees as well as the property of the data controller, employees and guests,
  • contact you in relation to execution of contracts to which you are not the party, but the data had been received as part of the contract execution,
  • determine, pursue or defend claims,
  • monitor and improve the quality of providing services, including handling complaints,
  • fulfill the legal obligation (of complying with provisions), including for settlement and tax purposes as well as in relation to the maintained accounting records, i.e. based on art. 6.1.c of GDPR,
  • execute an agreement to which you are the party or undertake actions, at your request, prior to concluding such agreement, including provisions of services for your benefit, i.e. based on art. 6.1.b. of GDPR.

Personal data for the above-metnioned purposes shall only be stored for the time required by processing.

Security of personal data

Considering the importance of personal data protection, Atrem S.A. have decided to appoint a Data Protection Officer in order to manage and supervise personal data processing.

The basis for which personal data protection security measures are implemented at Atrem S.A. is the Policy for Personal Data Protection at Atrem S.A.

As part of Atrem S.A. Integrated Mangementy System, also covering standards EN-ISO 9001:2015; PN-EN ISO 14001:2015, PN-N 18001:2004; PN-EN ISO 27001, an information security management system has been created.

The above-mentioned actions aim at regulating the rules of access to personal data and ensuring security thereof.

Recipients of personal data

Your personal data may be transferred to entities which cooperate with the Company within services provided for the benefit of the Company (e.g. subcontractors) and support of ongoing business process of the Company, customers and other entities that act on our behalf as well as banks, debt collection companies – each time within the scope necessary for the purposes of processing, in particular to execute an agreement to which you are the party or based on which the Company provides services.

Under no circumstances shall personal data be used with automated decision-making systems, which could affect your legal situation.

Data subject rights

Data subjects shall be entitled to the following rights:

  • access to own personal data,
  • correction of personal data,
  • removal of personal data,
  • limitation of personal data processing,
  • right to lodge a complaint with a supervisory authority in relation to personal data protection,
  • personal data move, covering the right to receive personal data and submit to another data controller or to request, when feasible, submitting such personal data directly to another data controller (within the scope in which the data are processed automatically and in order to execute and agreement or based on expressed consent),
  • right to object against processing of personal data (within the scope in which the data is processed under Company’s legally justified interests).
